A person who is not a party to an agreement to arbitrate may be bound to such an agreement only by ordinary principles of contract and agency.*fn1 David Powell was not a party to the insurance policy between Sphere Drake Insurance and its insured, and no principle of contract or agency binds him to arbitrate. Moreover, he asserts statutory claims against Sphere Drake that are outside of the policy. Therefore, we reverse the trial court's dismissal of his action against Sphere Drake.
